    <p>In 1969, the Ministry of Education issued a notice about high school students' political activities to the prefectural boards of education, which restricted the students' political activities and the teachers' teaching activities. Prior to the Ministry's notice, prefectural boards issued notices with similar contents. Under these notices, the political activities of high school students had been severely restricted.</p><p>In this paper, I argue that the Ministry and prefectural boards intended to exert improper control on education, which was prohibited by the Fundamental Law of Education of 1947. The reasons for reaching this conclusion are as follows.</p><p>1) The Ministry and prefectural boards restricted the activities of teachers and students by means of these notices. However, those restrictions were illegal because these notices had no legal power.</p><p>2) The notices limited the teachers' freedom in teaching, and forced the teachers to restrict the students' political activities both inside and outside school. Unjustly restricting teachers' freedom in teaching will limit their activities to ensure the students' right to learn. Although the high school students' political activities should be guaranteed as a human right, the Ministry considered their activities to be a disturbance of social order.</p><p>3) The Ministry insisted that the political activities of the students should be restricted for the sake of public welfare in the notice, but it was illegal to restrict the human rights of students based on public welfare.</p>

    This paper discusses the purpose of Article 14, "Political Education," of the Japanese Basic Law of Education, and includes the history of legislation, the interpretation of law, the explanation of terms and operational issues, in particular, in light of academic theories following the 2006 revisions to the Basic Law of Education. In 2015, when the voting age was lowered with amendments to the Public Office Election Law, the Ministry of Education reacted in that same year, abolishing the 1969 notice. The new notice reviews the political education and political activities of high school students under the new Article 14, Sections 1 and 2. This section explains the details of these new doctrines; in particular, how political education is to be understood under the revised Basic Education Act. There are two important points regarding the interpretation of Article 14 of the Basic Education Act. The first refers to the importance of imparting to students a rich opportunity for learning political education. Quality political education aims to foster knowledge and understanding of political systems, as well as to offer opportunities to exercise critical skills and test ideas touching on political morals and beliefs. It suggests that the environment in which political education takes place is not just schooling, but public education in general, including social education. In addition, political education should not be limited merely to teaching youth to become voters or to preparing them for understanding how elections work within the overall system. The second purpose of the new article is to reaffirm that the article does not encourage intense political activity on campus, nor does it trivialize political education itself. Subsection (2) states that teachers, principals and school employees during a teaching activity shall be prohibited from indoctrinating or inciting youth to support (or not) a particular political party. No limitation by an expanded interpretation of subsection (2) is permitted.
