In the case of the Hague Convention on the Civil Aspect of International Child Abduction, international jurisdiction for the child custody disputes and enforcement of judgements concerning child custody or visitation rights, it is critical for the court to respect children’s right to be heard and reflect its voice to the procedure properly in order to return or transfer the child promptly and to resolve the child custody disputes in harmonized way.
To protect the interest of the child, the Family Court which has significant experiences and achievements, in cooperation with execution officer, Central Authority and other professionals as well as other organization or agencies in foreign states, should consider the possibility or introducing its own system with both flexible and continuous participation of family court investigating officer and other professionals. -

我国中小企業のアジア諸国への展開を支援するにあたっては、同諸国における倒産法制について、実務的で分かり易い形で情報を提供することが重要な課題となっている。
本研究は、我々が実施した先行研究「解雇法制の国際比較」において構築した研究手法を応用し、中国、ベトナムなどアジア７ヶ国の最新の倒産法制について、日本と比較した国毎の特徴の抽出を行うものである。さらに、修正版世銀倒産法制指数等の定量指標を考案することにより、国毎の特徴を分かり易く示すとともに、日本との差異を生ぜしめている背景要因、すなわち、ビジネス文化、経済発展段階、宗教などの社会経済的な背景要因について、学際的・実証的観点から解明を行う。 -
