Mini-publics are a series of participatory and deliberative techniques, in which randomly selected members of the public are gathered to form a microcosm of the society, discuss a public issue and present policy recommendations. This project investigated the role of mini-publics for the governance of global, ultra long-term compound risks such as climate change and high-level radioactive waste disposal. While carrying out theoretical exploration from the viewpoint of science and technology studies (STS), science communication, deliberative democracy, and transition management, the research team conducted a mock citizens' jury on "decarbonization transition and the quality of life" with participants randomly selected from the general public. Through these investigations, it was found that public participation and deliberation using mini-publics can be instrumental in a variety of respects to the governance of such large-scale risks.
トランスナショナル・ローの法理論―多元的法とガバナンス

研究第3年度に当たる本年度の中心的活動は、法哲学会において行われた統一テーマ報告「法多元主義ーグローバル化の中の法」における報告であった(11月、東京大学）。同シンポジウムでは、研究代表者である浅野及び研究分担者である長谷川・原田・松尾が、本研究課題での成果を踏まえた報告を行い、会場との意見交換を通じて多くのフィードバックを得た。
また、研究代表者である浅野は、本研究課題における研究成果を単著『法多元主義 交錯する国家法と非国家法』としてまとめ、公刊した(11月）。
さらに、実証研究については、組織規範動態WGにおいては、民事法領域におけるソフトローに関する先行研究の分析を成果として公表すると共に、ソフトロー分析のための枠組に関する研究を進め、成果として公表した。
最後に、TNLに関し多角的な検討を続けるため、国内の研究者を定期的に研究会に招聘し、意見交換を行う活動も継続した。本年度は、今年度から研究分担者に加わった加藤紫帆氏による「国境を越えた文化財の不正取引に対する抵触法的対応」、また、加藤陽氏 （近畿大学法学部）による「国連法とEU法の相克―ラディカル多元主義の理論構造とその実践的意義―」（以上6月）、稲田龍樹氏（元学習院大学教授・弁護士）による「昭和民法（家族法）と協議」というテーマでの報告を基に議論した。
これらの活動を通じて、本研究課題についての研究は、大きく進展したということが出来る。
研究代表者である浅野が、本研究課題に関する成果を書籍『法多元主義 交錯する国家法と非国家法』としてまとめ、公刊することが出来たため。同書の公刊は、当初の計画以上の成果である。
今年度も、関連文献を随時物品費で購入し精査することを継続する。前年度の法哲学会での法多元主義に関するシンポジウムでの報告・意見交換を踏まえ、法哲学年報に理論面での最終成果を公表する。具体的には、研究代表者の浅野の他、研究分担者である松尾・原田・長谷川が執筆する。
また、昨年度までの方法論的検討を踏まえ、実証WG（松中を中心とした国際金融WGと清水を中心とした企業動態WG)において具体的テーマについて一定の成果を示す。京都・名古屋・札幌等において国内旅費を用いて打ち合わせ・研究会を開催しつつ、下記ワークショップを踏まえて公表する。
さらに、今年度も国内旅費を用いて法多元主義に精通する国内研究者を年1・2回招聘し、意見交換を継続する（場所は京都を予定している）。最後に、外国旅費を用いてTNLの中心的研究者を招聘して国際ワークショップを2月後半日本で開催し、理論面だけではなく実証面での研究成果を示した上でフィードバックを得ることとする。

We examined the changing relations of state, civil society, and market from the viewpoint of "a dynamic balance" of them. Major actors of globalized market have increased their political influences on policies of advanced countries and brought tendencies towards further disintegration of a society.
We focused on democracy seen as the key element of those inter-relations. Democratic institutions are not only for identifying the will of the present majotity but also for promoting opinion-formation with respect to possible roles the major instituions of a political society should perform in controlling capitalist market. We identified some major problems to be inquired further inherent in the idea of the democratic cotrol of the market.
Rethinking 'Politics Matters' in Contemporary Democratic Theory Through The Conceptual Expansion of Deliberative System

My researches conducted during the term are summarized as followings. First, I has reconsidered the concept of deliberative system through my book Deliberative Difficulties and Beyond (Kyoto: Nakanishiya Shuppan, 2017), co-authored contribution to the Oxford Handbook of Deliberative Democracy, and related some works. Second, I has engaged with rethinking the significance of reflection in deliberative democracy and published a book chapter and papers. Finally, my research during the term includes to clarify types of political theory. Through Introduction to Political Theory (Tokyo: Yuhikaku, 2017) and some other works, I have examined the uniqueness of the 'political political theory' differentiated from the 'normative political philosophy'.
Interdisciplinary study on cooperative policy making for the creative recovery of the Fukushima nuclear plant accident damage

Among many social and economical problems occurred by the Fukushima nuclear plant accident on March 11th 2011, the objects in this study are as follows; (1)information sharing the situation and problem of the claim of damages by victims, (2)Rearranging of issues and problems about liability, standard and scope of compensation, (3)Clarification of policy issues for the substantial remedy of victims, (4)Policy proposal for the creative recovery of victims and restore of disaster area and (5)Study of the process to develop from the remedy to the creative recovery and restore. As a result of this study, we clarified the approach to recognize actual problems, summary of issues for study objects of described above and proposed the solution to problems and policy frameworks of compensation for nuclear damages, process of decontaminating radioactive substance and so on.
Pluralism and Interaction of Liberalism and Its Institutions: Toward the Fusion of Thoughts of East and West and An Interdisciplinary Approach

This research project contains three sub-projects. The first sub-project examines western thoughts on liberty and public after the establishment of the Westphalian sovereignty, with a special focus on thoughts after the French revolution that include literature. The second sub-project examines social thoughts on liberty and institutions on liberty in modern and contemporary Japan. In particular, the focus has been placed on the evolvement of the liberalism and comprehensivism in the prewar period, as well as the establishment of the constitutional system in the post-war period Japan. Results and findings derived have been delivered to the general public through open seminars and workshops. The third sub-project is “the history of the exchange of thoughts in East Asian”, which focuses on the tension between the Confucian sphere and modern constitutionalism. A number of international symposiums and seminars have been jointly hosted with National Taiwan University on this subject.
