    ミャンマー憲法裁判所は、2011年の設置以来、年間数件の事件しか扱っておらず、人権保障という観点から、西欧立憲主義が意図する目的を果たせておらず、機能不全に陥っている。東欧・旧ソ連の社会主義国も、体制転換にともない、権力分立、人権保障といった西欧的な立憲主義理念のもと、多くの国が憲法裁判所設置した。本研究は、社会主義からの体制転換に着目し、ウズベキスタンを比較の対象とし、ミャンマーがなぜ憲法裁判所制度を導入し、社会主義・軍政時代の権力統合原理が違憲審査制度にどのような影響を与え、人権保障メカニズムの問題点を明らかにする。
    ミャンマー憲法裁判所は、軍事政権から民政移管した2008年憲法のもとで、2011年の設立以来、15件の判決しか出されていない。ウズベキスタンは、ソ連から独立後、1992年憲法が制定され、1995年に憲法裁判所が設立されたが、設立以来出された判決は20件にも満たない。初年度である2019年度は、ミャンマー及びウズベキスタンの憲法裁判所の判決の分析を行った。
    ミャンマー憲法裁判所で扱われる多くのケースは、大統領と議会の対立、議会内での与党と野党(軍部を母体とした政党または少数民族政党)の政治的対立に起因するものが多い。中には、地方政府の少数民族担当大臣及びその他の大臣の待遇の不均衡を是正したり、連邦議会及び州議会の立法権限に関して、州法と矛盾する2008年憲法制定以前の連邦法を廃止せずとも州法は有効であるとの判断を出したり、評価できる判決もある。しかし、設立翌年の2012年には、憲法裁判所の判決に不服であった議会が裁判官全員を弾劾し、司法の独立が危惧されている。アウンサンスーチー率いる国民民主連盟(NLD)が政権を握った2016年以降は4件の判決しかなく、弾劾事件の影響もありNLDの意向に反する判決は出されていない。
    ウズベキスタン憲法裁判所は、人権保障および少数政党の保護のための独立した機関として機能することが期待された。しかし、実際の判決を見てみると、社会権を保護するいくつかの判決が出されているが、自由権は逆に制約される現象が起きている。また、政治的な対立からも距離を置いている。ソ連から独立する直前の社会主義時代末期に、議会の諮問機関として憲法監督委員会が設置されたが、同委員会は国家による人権侵害に対して介入する特別な権限も付与され、現在の憲法裁判所よりもうまく機能していたのではないかと評価できる。
    初年度である2019年度は、シンガポールで行われた学会にて、アジアのポスト権威主義国の民主化プロセスにおける違憲審査機関の役割の比較研究と題したパネルにて、ミャンマー及びウズベキスタンの憲法裁判所の役割と判決の分析について学会報告を行った。名古屋大学法政国際教育協力研究センター(CALE)紀要であるAsian Law Bulletin第5号に掲載された。また、2019年10月にミャンマーにて開催されたワークショップ「アジアにおける違憲審査機関の出現と特徴―体制移行国の発展の比較研究」において、ウズベキスタン独立以前に、社会主義理論にもとづいて設立された憲法監督委員会にも立ち返り、どのように西洋的憲法価値を受容していったのかを報告した。同ワークショップでは、ミャンマー憲法裁判所裁判官、ミャンマー研究者に加え、シンガポール、韓国及びロシアの憲法研究者とも意見交換を行う機会も得た。2020年1月に名古屋にて開催されたシンポジウム「アジアにおける立憲主義の諸相―アジア的「文脈」とその論理―」に参加・報告した。同シンポジウムには、ミャンマーのみならず、東アジア、ASEAN、ユーラシア諸国の憲法研究者も参加し、社会主義からの体制移行、権威主義国家における違憲審査機関の役割など、比較研究を行うことができた。上述のワークショップ及びシンポジウムの報告は、近刊予定である。研究代表者である牧野は、ミャンマー憲法裁判所法の日本語訳を作成し、Asian Law Bulletin第5号に公表するなど、積極的に本研究の成果を公表している。また、研究分担者のイスマトフは、メルボルン大学ロースクールに客員研究員として1ヶ月滞在し、旧ソ連諸国の憲法を専門とする研究者との研究交流もうまれ、順調に研究を進めている。しかし、ミャンマーの憲法起草過程については十分な情報を得ることができなかった。
    2020年度は、両国の人権保障メカニズムの問題点を明らかにしたい。ミャンマー及びウズベキスタンは、体制転換にともない、市場経済・民主主義を掲げた新たな憲法をそれぞれ2011年及び1992年に施行した。それ以前の憲法は、社会主義理論にもとづき、自然権的な発想はなく、「人権」という用語は使われず、国家によって付与される「市民の基本権」として規定され、また自由権より社会権が重視された。体制転換後に新しく制定された憲法では、国際人権法などの影響を受け、自由権に関する新たな規定が設けられるなど、西欧立憲主義が想定する「人権」規定が盛り込まれた。しかし、現行の2008年ミャンマー憲法及びウズベキスタン1992年憲法は、「人権」という用語を用いず(ウズベキスタンについては一部「人権」を用いている)、「市民の基本的権利」とし、いまだ国家が権利を付与するという社会主義的発想のままである。社会主義理論にもとづき、個人の人権よりも、集団的または社会的利益が尊重されてきたが、現憲法においてもそれが受け継がれているように思われる。現に、ウズベキスタン憲法裁判所の判決は、社会権を保護するいくつかの判決が出されているが、自由権は逆に制約される現象が起きている。憲法裁判所の出した判決のうち、人権に関わる判決をさらに詳しく検証したい。
    また、両国は、日本のみならず様々な国からの法整備支援の対象国となっている。特に、人権に対する両国の対応については、国際社会から厳しく批判されているが、この法整備支援の過程で、人権概念がどのように変化していったかも見ていきたい。

    This research demonstrates why and how exactly the philosophies and measures of gravity of legal aid projects implemented thereby by donor-states in Uzbekistan vary and clarify how each donor-state tends to position human rights, democracy and the rule of law within own aid activities. It analyzes how human rights, democracy, and the rule of law in Uzbekistan as well as their perception within the local legal community, particularly academia, has been evolving, and towards which direction they may gravitate in the future.
    In the first year the following has been accomplished. First, a literature review has been completed. Based on this a theoretical ground for the subsequent parts of has been elaborated. Second, work has progressed on collecting and cataloging the legal assistance projects delivered by the selected donors, though this remains a work in progress. This is the most time-consuming elements of the research and will continue into the second year. Third, identifying the legal assistance methods and philosophies is also a work in progress. General perceptions among donor-actors and domestic scholars with regard to constitutionalism, human rights and democracy will be evaluated further. Finally, a presentation on one part of the research was made (Asian law and Society Conference)
    The progress is going reasonably well but the original schedule has proven to have been slightly delayed because of the situation with the COVID 19. The work on gathering information on laws and intended legal assistance projects in target jurisdiction is rather smooth, however, some of intended meetings with local experts have been delayed because of the pandemic. Some online meetings with local scholars and experts dealing with most recent legal transplantation projects were held.
    Work on the further elements described will continue and surveys (as mentioned in the original Research Proposal) are being prepared to be sent out. Preliminary contact with scholars in some (but not all) target jurisdictions in regard to these has been established and will be followed up on.
    Next year plan will also include a closer analysis of legal education in Uzbekistan in light of the newly adopted presidential decree on legal education and a number of initiatives to involve foreign partners into the process of legal education reform in Uzbekistan. This includes establishing new centers of law by China, Germany and the U.K.
