    This article provides a historical overview, for the benefit of English-speaking lawyers from the common law world, of the "title transfer security interest" as applied to real estate in Japan. The article traces the history of the interest from the end of the Tokugawa period and through the period of rapid economic growth in the latter half of the 20th century, as a telling illustration of the effect of rapid legal and economic change on judge-driven law-making in a nominally Civil Law jurisdiction. The article includes a close analysis of three modern Supreme Court precedents concerning this interest which, the author argues, demonstrate the dysfunctional nature of this interest as applied to real estate and the need for reform in this niche of Japanese secured lending law.

    This is the first of a two-part article on used goods dealer regulation in Japan. There are two ways of controlling theft: by raising the cost of committing the crime through heavier policing and stiffer penalties; or through restricting the market, and therefore the value, of stolen goods. Until the second half of the 20th century, the latter strategy played a significant role in Japanese crime control strategies, due to restrictions on mobility and a strong police power. This article provides an account of the transformation and ultimate erosion of this method of policing in the 20th century.
